1. Scope of application, legal language

 The services and products from www.strickmich-shop.de  www.strickmich-club.de are supplied by Strickmich! e.K., Dorfstr. 2, 23824 Damsdorf.

The legal language for all contracts and agreements is German. By using the site and purchasing any product you agree to the German AGB. These Terms and Conditions are an unofficial translation for information purposes, only the German AGB are legally binding.

 2. Subject matter of the contract

Subject matter of the contract is the sale of goods both physical as well as online through Strickmich! Shop or all other ways by Strickmich e.K. 

3. Contracting party

3.1 The purchasing contract is formed with Strickmich! e.K., Dorfstr. 2, 23824 Damsdorf („Strickmich! Shop“ hereafter)

 4. Ordering, closure of contract

4.1 All offers on the Strickmich! Shop website are non-binding and do not constitute offers in the legal sense. They are rather a request for the customer to make an offer to Strickmich! Shop to purchase products.

4.2 All offers are subject to availability. The number of the craft dyed yarns can be highly limited. If an ordered product should not be available, Strickmich! Shop will inform the customer and if applicable will refund all payments.

4.3 If your are interested a product, you may put it in your shopping basket without obligation by clicking on “add to shopping cart”. The shopping cart will appear as a bar leaving you the choice to “proceed to checkout” or “continue shopping”.  You can also access your shopping cart by clicking on the “edit shopping cart” button or the shopping cart symbol.

4.4. On clicking the “proceed to checkout” button an input page will appear. Registered customers can enter their email address and password to continue. If you are new to our shop, please enter your information here to register for a new customer account.

4.5. On the following page please select your preferred payment and shipping option. The available options will depend on the shipping country you have entered in your customer account. Proceed to the complete order page by clicking on “continue”.

4.6. On the following page you will get to an overview where you can review all details of your order. Please re-check your products, chosen payment and shipping option and change them if necessary. By selecting to accept our AGB as well as clicking on the button „complete payment" you will make a binding offer to form a contract regarding the purchase of the products.

4.7 The order process can be stopped at any time by closing the browser window. You may also correct any part of the process by clicking on the „Back” button.

 4.8 After the order process you will receive an automatic email that confirms the receipt of your order. This receipt confirmation does not constitute a binding contract. In the confirmation email you will also receive detailed information for payment via bank transfer as well as a Paypal link.

4.9. After we have received payment in full in our account (Paypal or Bank Account) you will receive an email confirmation of your payment. This email also does not constitute a binding contract yet. After we have checked your data, we will send you a payment receipt in form of a bill by email. Bills within the EU will explicitly show the value added tax. With this email we accept your offer of purchase and thus a contract is formed by this email in written form.

4.10 If a customer does not receive a confirmation email within 14 days of his offer and complete payment, he is no longer bound to his offer. If applicable, his payments will be returned in this case.

4.11 The ordering process as well as all other communication with the subscribers is conducted via email, some automated. The customer has to assure that the email submitted in the sign-up is correct and able to receive emails from Strickmich!. In particular, SPAM filters might have to be adjusted.

4.12 The information submitted in the sign-up will be stored electronically and only used to fulfill the contract. The AGB (terms and conditions) can always be viewed on our website. The order details as well as the AGB will also be sent to you in your order confirmation email. Only German is the official and binding contract language.

5. Right of withdrawal / Widerrufsbelehrung / Right of cancellation of the order

5.2 As a European consumer, you have the right to withdraw from the contract by German law. The official instruction follows (in German as required by law):

Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag an dem Sie oder ein von Ihnen benannter Dritter, der nicht der Beförderer ist, die Waren in Besitz genommen haben bzw. hat. Um Ihr Widerrufsrecht auszuüben, müssen Sie uns, Strickmich! Club, Dr. Peter L. Steck, Dorfstr. 2, 23824 Damsdorf, info@strickmichclub.de, Telefon 040 21107678 mittels einer eindeutigen Erklärung (z.B. ein mit der Post versandter Brief, Telefax oder E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist. Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.

Folgen des Widerrufs


Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet. Wir können die Rückzahlung verweigern, 
bis wir die Waren wieder zurückerhalten haben oder bis Sie den Nachweis erbracht haben,
dass Sie die Waren zurückgesandt haben, je nachdem, welches der frühere Zeitpunkt ist. 
Sie haben die Waren unverzüglich und in jedem Fall spätestens binnen vierzehn 
Tagen ab dem Tag, an dem Sie uns über den Widerruf dieses Vertrags unterrichten,
 an uns zurückzusenden oder zu übergeben. Die Frist ist gewahrt, wenn Sie die Waren vor 
Ablauf der Frist von vierzehn Tagen absenden. Sie tragen die unmittelbaren Kosten der Rücksendung der Waren. Sie müssen für einen etwaigen Wertverlust der Waren nur aufkommen, wenn dieser Wertverlust auf einen zur Prüfung der Beschaffenheit, Eigenschaften und Funktionsweise der Waren nicht notwendigen Umgang mit ihnen zurückzuführen ist.

 6. Price, Shipping Cost, Ownership

6.1 The offered prices are final prices and contains all German taxes where applicable.

6.2 The customer has to pay for packaging and shipping in addition to the subscription cost. This cost is also a final price and will vary depending on the shipping destination. You can find the exact price by region on the web page „Shipping information“. The shipping cost for your country will also be shown clearly and separately in the overview form before the binding order.

6.3 When shipping to countries outside the European Union, there might be additional costs for local taxes and customs or exchange fees etc. Strickmich! Shop is not responsible for any such fees, they are to be paid by the customer. Please inform yourself about the regulations within your country.

6.4 The products remain the property of Strickmich! Shop until all payments have been received.

6.5 Each customer is responsible to keep their shipping address correct and up-to-date in the customer account of www.strickmich-shop.de. Any return or shipping fees that are caused by a wrong shipping address are to be covered by the customer.

7. Payment Terms

7.1. Payment for the order has to be made in full before shipment.

7.2. The following payment methods are accepted: Money transfer (SEPA) to our bank account and Paypal. Via Paypal payment can also be made by credit card.

7.3. Payment by money transfer is free of charge from our end, please note that your bank may charge you a transfer fee.

8. Warranties

8.1 You are entitled only to warranties under German law subject to the following paragraphs 2 to 4 (in German).

8.2. Ansprüche des Kunden auf Schadensersatz sind ausgeschlossen. Hiervon ausgenommen sind Schadensersatzansprüche des Kunden aus der Verletzung des Lebens, des Körpers, der Gesundheit oder aus der Verletzung wesentlicher Vertragspflichten (Kardinalpflichten) sowie die Haftung für sonstige Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung von Strickmich! Shop, seiner gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen. Wesentliche Vertragspflichten sind solche, deren Erfüllung zur Erreichung des Ziels des Vertrags notwendig ist.

8.3. Bei der Verletzung wesentlicher Vertragspflichten haftet Strickmich! Shop nur auf den vertragstypischen, vorhersehbaren Schaden, wenn dieser einfach fahrlässig verursacht wurde, es sei denn, es handelt sich um Schadensersatzansprüche des Kunden aus einer Verletzung des Lebens, des Körpers oder der Gesundheit.

8.4. Die Einschränkungen der Absätze 2 und 3 gelten auch zugunsten von Vertretern und Erfüllungsgehilfen von Strickmich! Shop, wenn Ansprüche direkt gegen diese geltend gemacht werden.

9. Copyright of the Knitting patterns

9.1 All the knitting instructions and patterns contained in the Strickmich! Club are protected under international copyright and commercial property rights. The distribution within the Strickmich! Shop is by sales license to Strickmich! e.K., all copyrights remain with Martina Behm.

9.2 The purchasers do not acquire any property rights to the patterns, they just acquire the non-exclusive right to use the pattern for knitting the respective knitting product solely for their personal use. Any commercial use of the pattern or the respective knitting product is not allowed. Particularly it is not allowed to adapt, exploit, copy, distribute, expose or make the pattern available via internet, even an imitation is not allowed.

10. Urheberrechte und gewerbliche Schutzrechte

All copyright, design right, brand or picture rights as well as all other commercial property rights of the products, services and or websites and their content belong to Strickmich! Shop, or defined third parties. A use beyond the concessions made here requires explicit permission by Strickmich! Shop

12. Privacy

The entering of customer data that are required to handle the order (name, address, email address and ordered items) shall be on a voluntary basis. These data are stored for processing the order, strictly confidential, and only disclosed to third parties as needed to fulfill the order (explicitly the shipping companies). All data will be deleted upon request.

13. Liability for the content / Liability for links

The content of Strickmich! Club was created with great care. We accept no liability for the correctness, completeness and timeliness of the content. We also accept no liability for content/links of other Websites as long as we have no possibility to influence their content. It is always the respective provider or operator liable for their own content. Third-party websites have been examined with great care and to the best of our knowledge prior to establishing links to such; at this time, legal violations have not been noticeable. A permanent control of the contents of the linked sites, however, without concrete evidence of a violation of the law, is not reasonable. In the event that we refer to sites with content that gives cause for complaint, please inform us. External links are clearly marked; in any case of injury of rights these links will be removed immediately. All copyrights, design patents, trademarks and other intellectual property rights in the offered goods, services and / or the Website or its contents are with Martina Behm, or with a third party. Any use without explicit permission is not allowed.

14. Miscellaneous

14.1. This contract and all disputes arising with Strickmich! e.K. is governed by German Law. UN-purchase law / CISG is explicitly excluded.

14.2 Court of jurisdiction and legal venue is Hamburg, Germany.

14.3 Even if some regulations of the German AGB might be void, the remaining regulations of the AGB remain valid.

14.4 The European Commission is providing an online platform for mediating online conflicts. The page can be accessed at https://webgate.ec.europa.eu/odr/ 

 14.5 Consumers living in the European Union who experience a conflict with us, Strickmich! e.K., can contact an arbitration board.
